With reference to your Despatch No.432 of the 20th December last, I have the honour to inform you that, after the correspondence with this Government detailed on pages 28-35 of the enclosure hereto, Messrs. Howard and Stephens applied on the 24th of March last for special leave to appeal to the Supreme Court against the Judgment of Sir John Carrington in this case.

2. The application was dismissed, whereupon Messrs. Howard and Stephens applied on the 26th of April to the Supreme Court for leave to appeal to the Privy Council against the decision of the Court to grant such special leave. The Acting Attorney-General did not oppose the application and the Court made an order for leave to appeal to the Privy Council.

3. I have now to forward the enclosed copies of the Record of Proceedings connected with the appeal, furnished on behalf of Messrs. Howard and Stephens, and approved on behalf of this Government by the Crown Solicitor.
